Can I Remarry Before The Divorce Is Finalized?

In India, remarrying before the divorce is finalized is not legally permissible. The law requires that the divorce be finalized and the divorce decree granted by the court before either party can legally remarry.

Legal Procedure:

  1. Divorce Process: After filing for divorce, the couple must go through a legal procedure, which includes filing a divorce petition, attending court hearings, and waiting for the court’s decision. In the case of mutual consent divorce, a cooling-off period of 6 months is typically required.
  2. Remarriage Restrictions: According to Indian law, remarriage during the pendency of divorce (before the divorce is finalized) is not allowed. If someone remarries while still legally married, the new marriage will be considered invalid.
  3. Section 15 of the Hindu Marriage Act: It specifically states that a person cannot remarry until the divorce is final, as it would constitute bigamy. Similarly, for other religions and under the Special Marriage Act, remarriage can only occur after the divorce has been granted.

Consequences of Remarrying Before Divorce:

  • If a person remarries before their divorce is finalized, the second marriage may be considered void, and the individual could face legal consequences for bigamy.
  • Bigamy is a criminal offense under Section 494 and 495 of the Indian Penal Code (IPC). The person may be subject to imprisonment for up to 7 years.

Example:

If a person files for divorce, but chooses to remarry before the court issues the divorce decree, the second marriage would be considered legally invalid, and the person could be prosecuted for bigamy.
