Can Single Fathers Claim Maintenance From Financially Stable Wives?

Indian family law recognizes the right of a spouse to claim maintenance when financially dependent, regardless of gender. Single fathers who are unable to maintain themselves due to separation, divorce, or other reasons may seek maintenance from financially capable wives. Legal Framework and Judicial Approach

Right to Maintenance:

Under Section 125 of the CrPC and the Hindu Adoption and Maintenance Act, a spouse, including a husband, has the right to claim maintenance if unable to support himself.

Financial Dependency:

The father must prove he is financially dependent on the wife or lacks sufficient income or property for self-support.

Wife’s Financial Capacity:

Maintenance claims are granted considering the wife’s ability to pay without causing undue hardship.

Effect of Separation or Divorce:

Post-divorce or separation, maintenance may be claimed as alimony or permanent/temporary maintenance depending on circumstances.
