What Role Does the CBI Play in Extradition?

Answer By law4u team

The Central Bureau of Investigation (CBI) acts as the primary investigative agency responsible for executing and coordinating extradition-related operations within India. It plays a vital role in tracing, arresting, and handing over fugitives requested by foreign countries under the extradition framework.

Role of the CBI in Extradition

Coordination with Ministry of External Affairs (MEA)

The CBI works closely with the MEA, which is responsible for receiving and processing extradition requests from foreign governments.

Investigation and Apprehension

Upon receiving directives, the CBI assists in locating and arresting the fugitive within Indian jurisdiction based on the arrest warrant and provisional arrest requests.

Legal Proceedings Assistance

CBI provides evidence and documentation to the magistrate conducting the extradition inquiry.

It may participate in court proceedings as a prosecuting agency or assist the government in building the case for extradition.

Liaison with Foreign Law Enforcement

CBI coordinates with foreign agencies such as Interpol and counterparts in the requesting country for information sharing and operational support.

Ensuring Compliance with Laws

Ensures that the arrest and detention comply with Indian laws and respect the rights of the accused during the extradition process.

Example

A fugitive accused of cybercrime in Country X is believed to be hiding in India. The CBI, upon receiving an extradition request, tracks and arrests the person. It then assists the magistrate with evidence and coordinates with the MEA and foreign authorities until the fugitive is legally extradited to Country X.
