How Does International Law Regulate Outer Space Exploration?

The Moon Agreement (1984)

  • Peaceful Use and Non-Militarization: Space must be used only for peaceful purposes; no weapons of mass destruction allowed.
  • Freedom of Exploration: All states have the right to explore and use outer space without discrimination.
  • International Cooperation: Encourages sharing of information, scientific research, and joint missions.
  • Non-Appropriation: No state can claim sovereignty or ownership over any part of outer space or celestial bodies.
  • Environmental Protection: Preventing harmful contamination of space and celestial bodies.

Legal Mechanisms And Enforcement:

  • The United Nations Committee on the Peaceful Uses of Outer Space (COPUOS) oversees development of space law and cooperation.
  • Disputes related to space activities can be resolved through peaceful means including negotiation, mediation, or adjudication in international courts.

Example:

If Country A launches a satellite that accidentally damages Country B’s satellite in orbit, under the Liability Convention, Country A would be responsible for compensating Country B for the damages caused.
