Can Elder Abuse Lead To Criminal Prosecution?

Legal Provisions Supporting Criminal Prosecution For Elder Abuse

Indian Penal Code (IPC) Sections

Several IPC sections apply to elder abuse, including:

Section 319: Hurt

Section 320: Grievous Hurt

Section 375 & 376: Sexual Offences

Section 498A: Cruelty by Husband or Relatives

Section 406 & 420: Criminal Breach of Trust and Cheating (for financial abuse)

Maintenance and Welfare of Parents and Senior Citizens Act, 2007

This Act provides for maintenance and protection but also imposes penalties on those who neglect or abuse senior citizens, including imprisonment or fines.

Protection of Women from Domestic Violence Act, 2005

Process and Outcome of Criminal Prosecution

Filing a Complaint or FIR

Courts conduct trials and, if guilt is established, impose punishments such as imprisonment, fines, or both.

Example

An elderly woman suffers physical and emotional abuse by her son. She files a complaint, and the police register an FIR under IPC Section 498A and sections related to hurt. After investigation, the case goes to court, where the son is found guilty and sentenced to imprisonment and fine, ensuring justice for the victim.
