Yes, individuals with different nationalities can marry in court in India. The Special Marriage Act, 1954, allows for marriages between individuals of different nationalities, religions, castes, or creed to be solemnized and registered in India. This act provides a legal framework for civil marriages in India, including marriages performed in court. Here's how individuals with different nationalities can marry in court in India: Application: The couple intending to marry must give notice of their intention to marry to the Marriage Officer of the district where at least one of them has resided for at least 30 days prior to the date of giving the notice. The notice is then displayed in the office of the Marriage Officer for 30 days. Objections: During the 30-day notice period, any person can object to the marriage on specific grounds specified in the act. If no objections are received, the Marriage Officer proceeds with the marriage after the expiration of the notice period. Marriage Ceremony: After the notice period has elapsed, the couple, along with three witnesses, appears before the Marriage Officer for the solemnization of the marriage. The Marriage Officer performs the marriage ceremony in the presence of the couple and witnesses. Registration: Following the marriage ceremony, the Marriage Officer issues a marriage certificate to the couple, which serves as proof of their marriage. The marriage is then registered under the Special Marriage Act, 1954. Legal Recognition: Marriages solemnized and registered under the Special Marriage Act, 1954, are legally recognized in India and abroad. The marriage certificate issued by the Marriage Officer serves as legal proof of the marriage. It's important to note that couples intending to marry in court under the Special Marriage Act, 1954, must meet certain eligibility criteria, including being of legal marriageable age (18 years for the bride and 21 years for the groom), not being within the prohibited degrees of relationship, and not already being married. Additionally, individuals of different nationalities should ensure that their marriage will be recognized in their respective countries and may need to fulfill any additional requirements or formalities prescribed by their country's laws.
