As of my last knowledge update in September 2021, prenuptial agreements in India are not governed by any specific statutory law. However, they are recognized to some extent under the Indian Contract Act, 1872. Prenuptial agreements in India are often referred to as "prenuptial contracts" or "antenuptial contracts." Here are some key points to consider regarding prenuptial agreements in India: Validity: Prenuptial agreements are generally considered valid in India as long as they meet the basic requirements for a valid contract under the Indian Contract Act. This includes having free and informed consent from both parties, being executed without coercion or fraud, and being lawful. Contents: Prenuptial agreements can cover a wide range of issues, including the division of property, spousal support, financial responsibilities during marriage, and arrangements for any children. However, the agreement should not be unconscionable or against public policy. Registration: There is no specific requirement to register a prenuptial agreement in India. However, it is advisable to have the agreement notarized or witnessed by at least two individuals to establish its authenticity. Challenging Validity: If one party believes that the prenuptial agreement was signed under duress, coercion, or fraud, they may challenge its validity in court. Courts in India have the authority to set aside prenuptial agreements if they find them to be unfair or unconscionable. Enforcement: Enforcing prenuptial agreements can be challenging in India, as courts may not always uphold every provision. Courts may consider factors such as changed circumstances since the agreement was signed and the fairness of the provisions when determining enforcement. Child Custody and Maintenance: Prenuptial agreements may not have a significant impact on child custody and maintenance matters, as the courts in India prioritize the best interests of the child when making such decisions. Any provision in the agreement related to children must be in their best interests to be considered by the court. It's important to note that the legal landscape may change over time, and it's advisable to consult with a qualified family law attorney in India to get the most up-to-date and jurisdiction-specific information regarding prenuptial agreements. Additionally, the enforceability and recognition of prenuptial agreements can vary from one state or union territory in India to another, so local laws and court precedents should be considered.
