Nevertheless, there are certain exceptions to the nature or the kind of contract. For instance, if the agreement includes sale, purchase or even transfer of ownership of the land valued more than or equal to 100, it shall only be registered through stamp paper to have its value in the court of law or even to make the transaction valid. The stamp paper shall also apply to wills, guarantees, etc. Therefore, a simple paper can have evidentiary value in the court; however, it mainly depends on the nature of the content and is always advised to have a stamp paper for ease of transaction. Dear Client, as per your query, a plain paper agreement is legally valid and enforceable in India under the Indian Contract Act, 1872, provided it fulfills the basic criteria of free consent, proper consideration, and a valid purpose. It is not a requirement under the law that a valid contract has to be on a stamp paper, although a plain paper agreement may not be admissible in court under Section 35 of the Indian Stamp Act, 1899, if it is not stamped correctly. This can be remedied at a later time, as even an unstamped agreement can be made admissible by paying the stamp duty that was missing along with a penalty, which is up to 10 times the original duty.
