However, if the landlord withholds the deposit without valid reasons, the tenant can seek legal recourse. Steps and Remedies for Tenants to File a Recovery Suit: Send a Legal Notice: Before filing a suit, the tenant should send a legal notice to the landlord, demanding the return of the security deposit. The notice should mention the amount of the deposit, the period of tenancy, and the reason for the demand. The notice typically provides the landlord with 15 days to respond or return the deposit. If the landlord fails to respond or refuses to return the deposit, the tenant can proceed with legal action. File a Civil Suit: If the landlord does not return the deposit or provide valid reasons for withholding it, the tenant can file a civil suit in the civil court for the recovery of the deposit. The suit is typically filed under the provisions of the Indian Contract Act, 1872 and the specific tenancy agreements (if any).
